Terms & Conditions

1. Application and Acceptance

1.1. These Terms & Conditions apply to all mentorship programmes, workshops, consultations, critiques, and online teaching services provided by Nichola Eddery trading as Nichola Eddery Atelier (“the Atelier”, “the Mentor”, “we”, “us”).

1.2. By enrolling in a mentorship programme, booking lessons, or making payment, you (“the Student”) confirm acceptance of these Terms & Conditions.

1.3. The Atelier reserves the right to decline applications where the programme is not considered suitable for the Student’s goals, level, or commitment.

2. Mentorship Programmes

2.1. Mentorship programmes are individually tailored and structured around the Student’s level, goals, and chosen area of study.

2.2. The Atelier reserves the right to recommend a more suitable programme level based upon the Student’s experience, goals, and availability for study.

2.3. Programmes may include:

  • Live private tuition via Zoom

  • Demonstrations

  • Critiques and corrections

  • Assignments and study plans

  • Reference material recommendations

  • Professional guidance

2.4. The Atelier reserves the right to adapt teaching content and structure according to the Student’s development and progress.

2.5. The Student acknowledges that artistic development requires consistent independent practice outside scheduled lessons and that progress cannot be guaranteed within a fixed timeframe.

3. Scheduling and Attendance

3.1. Lessons are arranged by mutual agreement and conducted according to UK time.

3.2. Students are responsible for ensuring they have:

  • a stable internet connection

  • suitable art materials

  • an appropriate workspace

  • adequate lighting and camera setup

3.3. Students are encouraged to use two devices where possible:

  • one for communication and screen sharing

  • one positioned above the drawing or painting surface

3.4. If a Student arrives late, the lesson will still conclude at the scheduled time.

3.5. Students are limited to one live lesson and one Zoom critique per week unless otherwise agreed by the Atelier.

4. Payments and Refunds

4.1. Full payment is required no less than 3 days prior to the agreed programme start date in order to secure your booking.

4.2. All programme fees must be paid in British Pounds Sterling (£).

4.3. Payments may be made via PayPal or by debit or credit card through the Atelier website.

4.4.  Payments made via debit or credit card through an invoice provider may incur transaction and processing fees. In the event of cancellation prior to the commencement of the programme, any non-refundable processing fees incurred by the Atelier will be deducted from the refunded amount.

4.5. Instalment payments or payment plans are not offered.

4.6. Once commenced, mentorship programmes are non-refundable.

4.7. The Atelier reserves the right to suspend lessons or terminate the programme where payment obligations have not been fulfilled.

5. Programme Structure and Duration

5.1. Mentorship programmes are offered in the following durations:

  • 1 Lesson

  • 4 Week Programme

  • 12 Week Programme

  • 24 Week Programme

5.2. The first lesson must be taken within one month of purchase unless otherwise agreed in writing.

5.3. Each programme concludes upon expiry of its allocated duration from the date of the first lesson:

  • 1 lesson

  • 4 Week Programme — concludes after 4 weeks

  • 12 Week Programme — concludes after 12 weeks

  • 24 Week Programme — concludes after 26 weeks

5.4. Lessons and critiques are intended to be spaced consistently throughout the duration of the programme to support structured progress and continuity of study.

5.5. Alternating weekly between lessons and critiques is strongly recommended to support consistent progress, reflection, and refinement between sessions.

5.6. Any unused lessons, critiques, or programme components remaining after the programme concludes will be considered as forfeited and are non-refundable and non-transferable.

5.7. Students are limited to one live lesson and one Zoom critique per week unless otherwise agreed by the Atelier.

5.8. A minimum of 24 hours’ notice is required to reschedule a lesson. Lessons cancelled with less than 24 hours’ notice will be considered as taken.

5.9. Missed lessons without notice are non-refundable and non-transferable.

5.10. Please note that payments made via debit or credit card through an invoice provider may incur third-party transaction fees. In the event of cancellation prior to the commencement of the programme, any non-refundable processing fees incurred by the Atelier will be deducted from the refunded amount.

5.11. Additional extensions or exceptions may be granted solely at the discretion of the Atelier.

6. Student Commitment and Participation

6.1. The Student acknowledges that mentorship programmes are designed for serious and committed study.

6.2. Students are expected to complete assignments, undertake independent study, and engage consistently with the programme.

6.3. The Atelier cannot guarantee artistic outcomes, professional success, income, exhibition opportunities, or career advancement.

6.4. Artistic progress varies according to the Student’s level of commitment, practice, consistency, and individual development.

7. Intellectual Property and Teaching Materials

7.1. All teaching content, demonstrations, corrections, written materials, diagrams, recordings, and educational resources remain the intellectual property of Nichola Eddery.

7.2. Teaching materials may not be reproduced, distributed, published, shared publicly, or used commercially without prior written permission.

7.3. Students may not record lessons.

8. Conduct and Termination

8.1. The Atelier maintains a respectful and professional learning environment.

8.2. The Atelier reserves the right to refuse, suspend, or terminate mentorship where behaviour is considered inappropriate, abusive, disruptive, or disrespectful.

8.3. In such circumstances, refunds will not be issued.

8.4. The Atelier reserves the right to terminate the programme where communication repeatedly breaks down or where the Student fails to engage with the programme for an extended period without reasonable explanation.

9. Circumstances Beyond Reasonable Control

9.1. Neither party shall be liable for delays, interruptions, or cancellations resulting from illness, technical failures, internet interruptions, natural disasters, power outages, governmental restrictions, or circumstances beyond reasonable control.

9.2. Where possible, alternative lesson arrangements will be offered.

10. Privacy

10.1. Personal information shared by the Student will be used solely for the administration and delivery of mentorship services.

10.2. Student work may occasionally be shared on the Atelier website or social media for educational or promotional purposes unless the Student requests otherwise in writing.

11. Governing Law

11.1. These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

11.2. Any disputes arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
